பேச்சு சுதந்திரம் குறித்து உயர்நீதிமன்றம்

நற்பாங்குகளின் வரம்பினை மீறுவதற்காக என்று பேச்சு/கருத்துச் சுதந்திரத்திற்கான ஒரு உரிமையை யாரும் பயன்படுத்திக் கொள்ள முடியாது என்று சென்னை உயர் நீதிமன்றம் கூறியுள்ளது. 2023 ஆம் ஆண்டு பாரதிய நியாய சன்ஹிதா (BNS) சட்டத்தின் 296(b) (ஆபாசமானச் சொற்களை உச்சரித்தல்), 352 (அமைதியைச் சீர்குலைக்கும் நோக்கத்துடனான ஒரு அவமதிப்பு) மற்றும் 353 (பொது அமைதிக்கு குந்தகம் விளைவிக்கும் நோக்கத்துடன் கூற்றுக்களை கூறுதல்) ஆகிய பிரிவுகள் இந்த சிக்கல் குறித்த விதிகளைக் கொண்டு உள்ளன. கருத்துச் சுதந்திரம் என்பது யாருக்கும் "துஷ்பிரயோகம் செய்வதற்கான உரிமத்தை" வழங்கவில்லை என்று கொல்கத்தா உயர் நீதிமன்றமும் சமீபத்தில் கூறியுள்ளது.

HC on Freedom of speech

❖ The Madras High Court observed that the right to freedom of speech cannot be taken advantage of by anyone to cross the limits of decency. ❖ Bhartiya Nyaya Sanhita (BNS) 2023’s Sections 296(b) (uttering obscene words), 352 (intentional insult to provoke breach of peace) and 353 (making statements with the intent to disturb public tranquillity) deals this issue. ❖ Earlier the Calcutta High Court added that freedom of expression not gave anyone a “licence to abuse”.

அடுத்த ஆண்டின் தொடக்கத்தில் இருந்து எல்லையற்ற ஷெஞ்சன் மண்டலத்தின் முழு உறுப்பினர்களாக மாறுவதற்கு பல்கேரியா மற்றும் ருமேனியா ஆகிய நாடுகளுக்கு ஐரோப்பிய ஒன்றியம் அனுமதி வழங்கியுள்ளது. பல்கேரியா மற்றும் ருமேனியா ஆகிய இரண்டு நாடுகளும் 2007 ஆம் ஆண்டு முதல் ஐரோப்பிய ஒன்றியத்தில் உறுப்பினர்களாக உள்ளன. ஆனால், சட்ட விரோத குடியேற்றம் அதிகமாகும் என்ற அச்சத்தில், இந்த மண்டலத்தை விரிவுபடுத்துவதற்கு ஆஸ்திரியா எதிர்ப்பு தெரிவித்தது. 1985 ஆம் ஆண்டில் உருவாக்கப்பட்ட இந்த ஷெஞ்சன் மண்டலமானது தற்போது 29 உறுப்பினர்களைக் கொண்டுள்ளது. இது ஐரோப்பிய ஒன்றியத்தின் மொத்த 27 உறுப்பினர் நாடுகளுள் 25 நாடுகளையும், சுவிட்சர்லாந்து, நார்வே, ஐஸ்லாந்து மற்றும் லிச்சென்ஸ்டைன் ஆகியவற்றையும் உறுப்பினராகக் கொண்டுள்ளது. உள்நாட்டு எல்லைக் கட்டுப்பாடுகள் இல்லாத உலகின் மிகப்பெரிய பகுதியான இதில் சுமார் 400 மில்லியனுக்கும் அதிகமான மக்கள் இந்த மண்டலத்திற்குள் சுதந்திரமாகப் பயணிக்க முடியும்.

Schengen Zone - Bulgaria and Romania

❖ The European Union has cleared Bulgaria and Romania to become full members of the borderless Schengen zone from the start of next year. ❖ Bulgaria and Romania, both are members of the European Union since 2007. ❖ But Austria had objected to expanding the zone, fearing more illegal immigration. ❖ Created in 1985, the Schengen zone now comprises 29 members. ❖ It also has 25 of the 27 European Union member states plus Switzerland, Norway, Iceland and Liechtenstein. ❖ It is the world’s biggest area without internal border controls, where more than 400 million people can travel freely inside the zone.

Prior learning in higher education

❖ The University Grants Commission (UGC) has unveiled the draft guidelines for Recognition of Prior Learning (RPL). ❖ It aims to bridge the gap between informal, non-formal, and formal education by assessing and recognising previously acquired knowledge, skills, and abilities. ❖ This framework enables the individuals to formalise their competencies and earn credits, paving the way for their integration into the formal education system. ❖ Through this, the student can earn up to 30 percent of the required credits for a degree programme. ❖ The UGC aims to implement RPL for university admissions and job placements by 2026. ❖ It creates diverse and flexible pathways for individuals with various educational backgrounds and learning experiences to access higher education based on their demonstrated competencies.

குறைபாடுகள் குறித்து CAG அறிக்கை

இந்தியத் தலைமைக் கணக்குத் தணிக்கை அமைப்பானது, தமிழ்நாட்டில் 2011 ஆம் ஆண்டு கடலோர ஒழுங்குமுறை மண்டலம் (CRZ) அறிவிப்பின் அமலாக்கத்தில் உள்ள குறிப்பிடத்தக்க தாமதங்கள், மீறல்கள் மற்றும் குறைபாடுகளை எடுத்துரைத்துள்ளது. 2015 ஆம் ஆண்டு முதல் 2022 ஆம் ஆண்டு வரை தமிழ்நாடு மாநிலக் கடலோர மண்டல மேலாண்மை ஆணையம் ஆனது (TNSCZMA), 175 திட்டங்களில் 114 திட்டங்களை மத்திய சுற்றுச்சூழல் அமைச்சகத்தின் பரிசீலனைக்குப் பரிந்துரைக்காமலேயே அவற்றிற்கு நேரடியாக ஒப்புதல் அளித்துள்ளது. தமிழ்நாடு மாசுக்கட்டுப்பாட்டு வாரியத்திடம் இருந்து கட்டாயமாக தடையில்லாச் சான்றிதழ் பெறாமல் கழிவுநீர் வெளியேற்றம் செய்வது தொடர்பான சுமார் 23 திட்டங்களுக்கு ஒப்புதல் அளிக்கப்பட்டது. சென்னை, செங்கல்பட்டு மற்றும் தூத்துக்குடி ஆகிய பகுதிகளில் மேம்பாட்டுப் பணிகள் எதுவும் மேற்கொள்ள அனுமதியில்லா மண்டலத்தில் 90 அங்கீகரிக்கப்படாத கட்டுமானப் பணிகள் மேற்கொள்ளப்படுவது குறித்து கண்டறியப்பட்டன. மேலும், இந்து சமய மற்றும் அறநிலையத் துறை (HR&CE) ஆனது, தணிக்கைக்காக தலைமைக் கணக்குத் தணிக்கை அலுவலகத்திடம் எந்தப் பதிவுகளையும் அளிக்க இல்லை. ஆனால் HR & CE துறையின்படி, சமய நிறுவனங்கள் தொடர்பான பதிவுகளை ஆய்வு செய்வதற்கு CAGக்கு அதிகாரம் இல்லை. CAG தணிக்கையின் வரம்பு மாநிலத்தின் ஒருங்கிணைந்த நிதியில் இருந்து வழங்கப் படும் நிதிக்குள் மட்டுமே அமைய வேண்டும். கடமைகள், அதிகாரங்கள் மற்றும் பணி நிபந்தனைகள் (DPC) என்ற சட்டத்தின் 14வது பிரிவின் கீழ் அரசாங்க மனிதவள மற்றும் அறநிலையத் துறையால் வழங்கப் பட்ட மானியங்கள் தனியாக தணிக்கை செய்யப்படலாம்.

CAG report on inconsistencies

❖ The CAG of India has highlighted significant delays, violations, and lapses in the enforcement of the Coastal Regulation Zone (CRZ) Notification, 2011, in Tamil Nadu. ❖ From 2015 to 2022, the TNSCZMA directly approved 114 out of 175 projects without recommending them to the union Ministry of Environment. ❖ As many as 23 projects involving the effluent discharge were approved without the obtaining mandatory No-Objection Certificates from the Tamil Nadu Pollution Control Board. ❖ Around 90 unauthorised constructions were identified in the No Development Zone across Chennai, Chengalpattu, and Thoothukudi. ❖ Also, the Hindu Religious and Charitable Endowments (HR&CE) Department not produced any records to CAG for the audit. ❖ As per the HR&CE department, there was no jurisdiction for the scrutiny of the records pertaining to religious institutions. ❖ The scope of the CAG audit was to be restricted to the funds released from the consolidated fund of the State. ❖ The grants released by the government HR&CE department to the alone could be audited under Section 14 of the DPC Act.
